    THAT the Township of Huron-Kinloss Council hereby adopts the November 15, 2021 Council Meeting Minutes and the December 6, 2021 Committee of the Whole Meeting Minutes as presented.

Mark & Karen Stanley Z-2021-063
CON 5 LOTS 1 & 2 (Huron), Township of Huron-Kinloss known geographically as 1389 CONCESSION 6 E.

Monica Walker Boulton, Bruce County Planner explained that the purpose of the application is to facilitate a surplus farm dwelling severance of a +/-1.03 ha lot from an 80.94 ha agricultural parcel at 1389 Concession 6 E, in the Township of Huron Kinloss. An amendment to the Zoning By-law is required to rezone the lands from General Agriculture (AG1) to General Agriculture Special (AG1-25.1) and General Agriculture Special with a Holding (AG1-25.1-H1) to prevent development of a future dwelling for the retained farm parcel. The severed non-farm lot is to be rezoned from General Agriculture (AG1) to Agricultural Residential Special with a holding (AG3-25.2-H1). The Environmental Protection (EP) zone will remain unchanged. A holding provision requiring an Archaeological Assessment for the lands containing high archaeological potential is proposed.

Comments from Council
Questioned which watercourse requires the holding provisions for archeological assessment for future development and noted that archeological assessments are expensive.  The planner referred back to the report and noted the watercourse is unnamed and explained that the watercourse is within the current environmentally protected zone.

    THAT the Township of Huron-Kinloss Council hereby approves the zoning application of Mark and Karen Stanley for CON 5 Lots 1 & 2 (Huron) known as 1389 Concession 6E to rezone the property from General Agriculture (AG1) to General Agriculture Special (AG1-25.1), General Agriculture Special Holding (AG1-25.1-H1), Agriculture Residential Special Holding (AG3-25.2-H1) AND Environmental Protection (EP) to facilitate a surplus farm dwelling severance AND FURTHER approve the appropriate By-law coming forward.

Neal Morris, P. Eng, K. Smart Associates presented the drainage report and went through the background of the drain, explaining that the engineering report was prepared pursuant to Sections 76 and 78 of the Drainage Act. He explained the assessment, project cost breakdown, and samples of riffle structures. 

Questions from Council
A question was posed on the assessment, it listed assessment for property owners twice with two separate numbers. The Engineer explained that it was a mistake and confirmed the correct amount of landowners of $508,044.

Council received the letter of Ian Courtney and explained that assessment costs would be heard at the Court of Revision in January.

    That the Township of Huron-Kinloss Council hereby approves Report Number DRAIN 2021-12-27 prepared by Grant Collins, Drainage Superintendent and approves the Clark Creek Municipal Drain 2021 Report prepared by K. Smart and Associates AND FURTHER authorizes provisional approval on tonight’s agenda AND FUTHER approves the Court of Revision to take place virtually on Monday January 10, 2022, at 7:00 p.m.
