Mayor Twolan called the meeting to order at 7:00 p.m.

Mayor Twolan, declared a pecuniary interest on the following items: 6.5 William Street N Improvements Staff Report, 6.8 Huron Road Public Right of Way - Expropriation Staff Report, 8.12  William Street N Improvements By-Law and 8.14 Land Expropriation Huron Road By-Law. 

Mayor Twolan left the meeting when the items were being discussed.

    THAT the Township of Huron-Kinloss Council hereby adopts the September 9, 2020 Council Meeting Minutes and the September 14, 2020 Council (Planning) Meeting Minutes as presented.

Yolanda Ritsema, BBBS Kincardine provided an update on the past year and the challenges they are experiencing due to the Covid-19 pandemic.  Ms. Ritsema gave a high level overview of what the BBBS Kincardine is doing to raise funds and the benefits for the littles participating in the program.  

Point Clark Boat Club members Ellen Lowry, Elliott Lowry and Monica Hartman addressed Council regarding the deterioration of the Point Clark harbour break wall.

Ellen Lowry is a member of the High-water Committee for the Point Clark Boat Club. She gave an overview of the Club and explained that it is a non-profit Club run by volunteers. They have a licence of occupation for the harbour. They currently have 96 members and increase of 35 members this year. She explained that the harbour is open to the public, residents fish off the harbour walls, enjoy sunsets, sit on the benches and launch pleasure crafts even if they are not members.

The high level of water is causing the walls to deteriorate, and she explained that action needs to be take before the walls break as it is degrading quickly with each storm that passes. The Club is of the opinion that the north tip of the break wall may not survive the November gales.

She explained that they have the resources to fix the north tip at a cost of approximately $35,000 however, the financial commitment for the entire project is beyond the Club’s resources, they are requesting the Township to take over the remainder of the break wall project.
They have had difficulty with getting the permits due to COVID-19. They now have them in place for the north tip and the project can be ready for January 2021. 

Elliott Lowry explained the plan to rehabilitate the harbour wall and the construction involved. They have a contractor ready to start the work on the north tip this week.

Monica Hartman explained the membership of the Boat Club, how the boat launch is accessible to the public. The Boat Club property is treated as public domain and is open and accessible to the public, they leave it open to public access promote community well being. During the beautification it has transformed to a community space for the public to enjoy
Council commented that the project is a significant cost and confirmed with staff that it will be engineered. It was noted that it would be Township staff that would look after the project and it would be done in January 2021. Staff will research all available grant opportunities.

    That the Township of Huron-Kinloss Council hereby approves Report Number CS2020-09-39 prepared by Mike Fair, Director of Community Services AND approves the Harbour Wall Remediation Plan as presented AND FURTHER authorizes and exemption from the purchasing and procurement policy and grants pre-budget approval of up to $450,000.00 plus applicable taxes to proceed with the Harbour Wall Armour Stone installation including water flow pipe and final finishing recommendations for the harbour wall.

    That the Township of Huron-Kinloss Council hereby approves Report Number CS2020-09-38 prepared by Mike Fair, Director of Community Services AND authorizes waiving the fee for the Ripley Lions September 28th 2020 event AND FURTHER authorizes waiving the fees for the Lucknow Book Club until their safe return to Lucknow Library, AND FURTHER authorizes AA meetings a 50% cost reduction in the Point Clark Community Centre fees for 2020 and 2021 which can then be revisited in 2022.

    THAT the Township of Huron-Kinloss Council hereby supports The Township of South Glengarry in asking the Ontario Government to provide funding to increase the full-time positions in place of casual and part time positions in long-term care facilities and to further enact regular inspections of all long-term care facilities and FURTHER directs staff to forward a copy of the resolution to The Honourable Prime Minister of Canada, Mr. Douglas Ford, The Right Honourable Premier of Ontario, and all Municipalities within Ontario.

    THAT The Township of Huron-Kinloss Council along with the City of St. Catharines, show support to the City of Toronto in their legal challenge of the amendments made under Bill 184, Section 83; that states: “Refusal for certain arrears of rent” If a hearing is held in respect of an application under section 69 for an order evicting a tenant based on arrears of rent arising in whole or in part during the period beginning on March 17, 2020 and ending on the prescribed date, in determining whether to exercise its powers under subsection the Board shall consider whether the landlord has attempted to negotiate an agreement with the tenant including terms of payment for the tenant’s arrears. The City Council of Toronto voted 22-2 in support of a legal challenge of Bill 184 Section 83 and FURTHER directs staff to forward a copy of this resolution to the Honourable Douglas Ford, Premier, the Honourable Steve Clark, Ministry of Municipal Affairs and Housing and all Municipalities in Ontario.
